Terms of accommodation

These are the full terms and conditions of accommodation at our properties. By submitting a booking request you agree to the following terms and conditions:

1 Definitions
  • Proprietor: S A Symington and N A Symington.
  • The Client means, in addition to the person completing the booking form, all other persons on whose behalf he is completing the same and he warrants that he has the authority to sign on their behalf.
2 Booking

Bookings can only be accepted by persons over 18 years of age and will not be valid until the signed booking form and appropriate deposits have been received by the Proprietor and the Proprietor has sent the confirmation of booking to the Client. The Proprietor reserves the right to refuse or terminate a reservation at our discretion at any time.

3 Method of Payment
  • A booking deposit of £75 per week must be sent with the booking form.
  • The balance will be due no later than 6 weeks before commencement of holiday.
  • If less than 6 weeks to commencement of holiday the full amount must be paid.
  • In the event of non-payment on the due date, the Proprietor reserves the right to cancel the holiday and the booking deposit is forfeited.
4 Arrival and Departure

Weekly stays or longer will always start on a Saturday. The house/apartment will be ready for you to take over any time from 3.00pm. The keys will be made available upon arrival. Please do not arrive early because time is needed to clean the property thoroughly between lets. We also request that you leave the property on departure day by 10.00am.

5 Cancellation by the Client

Any cancellation of the booking by the Client must be in writing from the person who signed the booking form. Cancellation will apply from the date of receipt of the cancellation and will involve the following cancellation charges:

  • More than 8 weeks prior to the commencement date: forfeit of booking deposit.
  • 56-42 days before commencement: 60% of holiday cost.
  • 41-28 days before commencement: 80% of holiday cost.
  • 27-1 day(s) before commencement: 100% of holiday cost.

We strongly advise you to take out adequate holiday insurance.

6 Liability of the Proprietor
  • The Proprietor reserves the right, in addition to its right in section 3 above, to cancel the booking at any time or for any reason before the balance of the cost of the holiday has been paid (6 weeks before commencement of holiday). After the balance of the cost of the holiday has been paid the Proprietor reserves the right to cancel the booking as a result of circumstances amounting to force majeure. In the event of cancellation under this paragraph, the Proprietor shall be under no liability to the persons affected save only to refund all monies paid by or in respect of such persons.
7 Exclusion of Liability

The Proprietor shall be under no liability whatsoever to the Client for any loss or damage to any luggage, jewellery, personal effects or other property of the Client or for any loss, delay or inconvenience or any fatal or other injury or illness suffered by the Client and shall not be liable for any consequential damage or loss caused by breach of the Proprietor of its contractual duty to exercise diligence in making arrangements for the Client. This also applies to any person whom the Client may invite into the accommodation and grounds of the property, during the period of their stay.

8 Breakages and Damages
  • The inventory provided should be checked on arrival and departure. The Proprietor reserves the right to make a claim for damages to the building, breakages or loss of any of the contents and the value of any such claim must be paid for by the Client at the end of your stay. The Client must undertake to notify the Proprietor of any damages or breakages. The Proprietor reserves the right to enter your accommodation giving reasonable notice, except in the case of an emergency, for the purpose of checking the building and contents. Outgoing Clients are asked to leave the premises, furniture and equipment in the same condition they found it, clean and tidy, with special attention to the cookers.
  • The agents will then not be liable for any act, neglect or default on the part of the owner or any other person, nor for any accident, damage, loss or injury, expenses or inconvenience to any person or thing brought on to the property, nor for personal injury or loss of life.
  • Electric and other failures must be reported immediately to the Proprietor and the Client must not attempt to effect repairs themselves.
9 Public Services

The Proprietor cannot be held responsible for failure of public services (e.g. water and electricity) and disturbance which is beyond the control of the Proprietor. The Proprietor will make every endeavour in so far as it is able to ensure that failure or disturbance is corrected as quickly as possible.

10 Extra Persons in the House

The Client warrants that the number in the party as stated by them on the booking form will not be exceeded and that the Proprietor is fully entitled to terminate your accommodation if at any time during the occupation this condition is breached.

11 Pets

The Client accepts that pets are not permitted at the property. A breach of this condition will be grounds for instant termination of the accommodation.

12 No Smoking

The Client accepts that smoking is not permitted in the property. A beach of this condition will be grounds for instant termination of the accommodation.

13 Termination of Stay

The Proprietor reserves the right to terminate occupancy at our discretion at any time.

14 Advertising

The Client accepts that whilst representation both verbal and visual contained in advertising matter, brochures and on websites are made in good faith and have been carefully scrutinised, they are only intended to give general guidance as to the character of the accommodation, they do not form part of any agreement with the Proprietor.

15 Complaints

In the event of any complaint this must be notified to the Proprietor during the occupancy and inspected by the Proprietor or one of its representatives, to establish the voracity of the complaint. Un-inspected complaints or complaints notified after the holiday has been completed cannot be upheld.

 

The Client will undertake to observe the rules in the above terms and conditions.

By submitting a booking for accommodation, the Client is declaring the he has read and fully understood the terms and conditions of accommodation listed above.
